Argo Transit Privacy Policy

Introduction
Argo Transit Corporation and its affiliates (“Argo”, “we”, “us” or “our”) respect your privacy and are committed to protecting it by complying with this policy.
This Privacy Policy describes:- the types of information that Argo may collect or that users and riders (“you”) may provide when you download, install, register with, access, or use (a) the Argo | Transit application, and the websites, content, technologies, networks, infrastructure, facilities, and platforms used with or for that application (the “Online Argo Transit Platform”), or the Argo | Transit communications system, and the content, technologies, networks, infrastructure, and facilities used with or for that system (the “Offline Argo Transit Platform”, and together with the Online Argo Transit Platform, the “Argo Transit Platforms”) and (b) the local transit services made available through the Argo Transit Platforms (the “Services”) for the applicable Ontario municipality in which you are using the Argo Transit Platforms and/or the Services (as applicable, the “Municipality”),
- Argo’s practices for collecting, using, maintaining, protection, and disclosing that personal information.
This policy applies only to information we collect in the Argo Transit Platforms, when you use the Services, in email, text, and other electronic communications sent through or in connection with the Argo Transit Platforms.
This Privacy Policy DOES NOT apply to information that:- Argo collects offline or on any other apps or websites, including websites you may access through the Argo Transit Platforms.
- You provide to or is collected by any third party.
Our websites and apps, and these third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Privacy laws in Canada generally define "personal information" as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person.
This Privacy Policy forms part of our Terms of Service, available at www.rideargo.com/terms-of-service. Please review this entire document carefully.
By downloading, registering with, or using the Argo Transit Platforms, or using the Services, you indicate that you understand, accept, and consent to the practices described in this Privacy Policy. You can withdraw your consent at any time, however, if you choose to do so, we may no longer be able to provide you with the Argo Transit Platforms or Services.
- What personal information do we collect?We collect information about you through:
- Direct interactions with youwhen you provide it to us, for example, by filling in a registration form, calling us or corresponding with us.
- Automated technologies or interactions, when you use the Online Argo Transit Platform, for example, usage details, IP addresses, and information collected through cookies and other tracking technologies, or use the Services, for example, information collected via cameras located on Argo vehicles.
The types of information that we collect include:- Personal information that we can reasonably use to directly or indirectly identify you, such as your name, mailing address, email address, telephone number, internet protocol (IP) address, user name or other similar identifier, billing and account information, and any other identifier we may use to contact you ("personal information").
- Non-personal information that does not directly or indirectly reveal your identity or directly relate to an identified individual, such as demographic information, or statistical or aggregated information. We may derive non-personal statistical or aggregated data from personal information. For example, we may aggregate personal information to calculate the percentage of users accessing the Services at a certain point in the day.
- Technical information, including your login information, device type, time zone setting, and usage details.
Information You Provide to UsWhen you download, register with, or use the Argo Transit Platforms, we may ask you to provide:- Information by filling in account creation forms. This includes information you provide when registering to use the Argo Transit Platforms, and or requesting or using our Services. We may also ask you for information when you report a problem with the Argo Transit Platforms or Service.
- Information about the number of individuals travelling with you, including whether any of those individuals are under 5 years of age (used to determine fare) or have accessibility needs.
- Records and copies of your correspondence, including email addresses and phone numbers, if you contact us.
- Details of transactions you carry out through the Argo Transit Platforms. We may require you to provide financial information before paying fares through the Argo Transit Platforms.
- The address of your pickup and dropoff point, and any locations that you save for future use in the Online Argo Transit Platform.
Automatic Information Collection and Tracking TechnologiesWhen you download, access, or use the Online Argo Transit Platform, it may automatically collect:- Usage details. When you access and use the Online Argo Transit Platform, we may automatically collect certain details of your access to and use of the Online Argo Transit Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Online Argo Transit Platform.
- Device information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
- Location information. The Online Argo Transit Platform collects real-time information about the location of your device to allow you to schedule pickups and dropoffs and to track your trips. Certain features require location information to work.
- Video Surveillance. Our vehicles may be equipped with surveillance cameras that capture video of the interior and exterior of such vehicles.
The technologies we use for this automatic data collection may include:- Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our Argo Transit Platforms.
- Web beacons. Pages of the Argo Transit Platforms may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit Argo, for example, to count users who have visited those pages and for other related Argo Transit Platform statistics (for example, recording the popularity of certain app content and verifying system and server integrity).
We may also use these technologies to collect information about your activities over time and across third-party websites, apps or other online services (behavioural tracking). The information we collect automatically is statistical information and may include personal information. We may maintain it or associate it with personal information we collect in other ways, that you provide to us, or receive from third parties.
If you do not want us to collect this information do not download the Online Argo Transit Platform or delete it from your device. Note, however, that opting out of the Online Argo Transit Platform's collection of location information will cause its location-based features to be disabled.
Third-Party Information CollectionWhen you use the Online Argo Transit Platform or its content, certain third parties collect information about you or your device. These third parties may include:- Advertisers, ad networks, and ad servers.
- Companies who provide and operate Argo’s vehicles
- The Municipality
- Analytics companies
These third parties may use cookies alone or in conjunction with other tracking technologies to collect information about you when you use the Online Argo Transit Platform or Services. They may use this information to provide you with behavioural advertising or other targeted content. We do not control these third parties' tracking technologies or how they use them. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. - How do we use your personal information?We use information that we collect about you or that you provide to us, including any personal information:
- To provide you with the Argo Transit Platforms and their contents.
- To provide you with Services that you request from us.
- To fulfill the purposes for which you provided it or that were described when it was collected or any other purpose for which you provide it.
- To carry out our obligations and enforce our rights in any contracts with you, including for billing and collection or to comply with legal requirements.
- To notify you when Online Argo Transit Platform updates are available, and of changes to the Services.
- To improve our Argo Transit Platforms, products or services, or customer relationships and experiences.
- As permitted or required by applicable law or regulatory requirements.
- for any additional purposes for which we have obtained your consent.
We may use your personal information without your knowledge or consent where we are permitted or required by applicable law or regulatory requirements to do so.
Usage information that we collect helps us to improve our Argo Transit Platforms and to deliver a better and more personalized experience, including by enabling us to
- Estimate rider demand and usage patterns.
- Store information about your preferences and customize our Online Argo Transit Platform according to your individual usage patterns.
- Recognize you when you use the Online Argo Transit Platform.
We use location information we collect to allow you to set and save your pickup and dropoff locations.
We use video surveillance footage for security purposes.
When do we disclose your personal information?
We may disclose aggregated information about you, and information that does not identify any individual, without restriction.
We may share your personal information with our affiliates, our respective employees, contractors, consultants, service providers and other parties who require such personal information to assist us with providing the Argo Transit Platforms and Services, and managing our relationship with you, including third parties that provide services to us or on our behalf.
Personal information may also be disclosed or transferred to another party during the course of, or upon completion of, a change in ownership of, or the grant of a security interest in, all or a part of Argo or its affiliates through, for example, an asset or share sale, or some other form of business combination, merger or joint venture, provided that such party is bound by appropriate agreements or obligations and required to use or disclose your personal information in a manner consistent with the use and disclosure provisions of this Privacy Policy.
Finally, your personal information may be disclosed:- as permitted or required by applicable law or regulatory requirements;
- to comply with any court order, law, or legal process, including to respond to any government or regulatory request, according to applicable law.;
- as part of Argo’ regular reporting activities under applicable law to protect the rights and property of Argo;
- to enforce our rights arising from any contracts between you and us, including the Argo | Transit Terms of Service, and for billing and collection;
- if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Argo, our customers, or others. This includes exchanging information with other companies and organizations for fraud prevention and credit risk reduction;
- during emergency situations or where necessary to protect the safety of a person or group of persons; and
- for any additional purposes for which we have obtained your consent to disclose your personal information.
- Transferring your personal information
We may transfer personal information that we collect or that you provide us to contractors, service providers, and other third parties we use to support the Argo Transit Platforms (such as analytics providers that assist us with Argo Transit Platforms improvement and optimization) and Services (such as vehicle providers) and who are contractually obligated to keep personal information confidential, to use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy.
We may process, store, and transfer your personal information in and to other countries with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information. Whenever we engage a service provider, we require that its privacy and security standards comply with this policy and applicable Canadian laws.

By submitting your personal information, engaging with the Argo Transit Platforms, or using the Services you consent to this transfer, storage, or processing.
- Your consent is important to us.
It is important to us that we collect, use, and disclose your personal information only when we have your consent to do so. Depending on the sensitivity of the personal information, your consent may be implied or express. We may collect, use or disclose your personal information without your knowledge or consent where we are permitted or required to do so by applicable law or regulatory requirements.
We will usually seek your consent before or at the time that we collect your personal information. In certain circumstances, your consent may be obtained after collection but prior to our use or disclosure of your personal information. If we plan to use or disclose your personal information for a purpose not previously identified (either in this Privacy Policy or separately), we will endeavour to advise you of that purpose before such use or disclosure.
You may change or withdraw your consent at any time, subject to legal or contractual obligations and reasonable notice, by contacting our Privacy Officer in writing. If you withdraw or vary your consent, we may not be able to provide you with the Argo Transit Platforms or Services.
- How is your personal information protected?
Argo will use commercially reasonable physical, technical and procedural safeguards that are appropriate based on the sensitivity of the personal information. These safeguards are designed to prevent your personal information from loss and unauthorized access, collection, use, disclosure, copying, modification, disposal or destruction.
The safety and security of your information also depends on you. Where we have given you (or you have chosen) a password for access to certain parts of our Online Argo Transit Platform, you are responsible for keeping it confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the Internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the Argo Transit Platforms. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any Argo Transit Platforms privacy settings or security measures.
- Data retention
Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize or aggregate your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.
- Children under the age of 13
The Argo Transit Platforms are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Argo Transit Platforms. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Argo Transit Platforms. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact the Privacy Officer.
- Updates to your personal information.
It is important that the information contained in our records is both accurate and current. If your personal information happens to change during the course of our relationship, please keep us informed of such changes by updating your profile within the Online Argo Transit Platform.
- Access to your personal information.
You can ask to access the personal information that we have received from or possess about you. If you want to review, verify, or correct your personal information, please contact our Privacy Officer. Please note that any such communication must be in writing.
When requesting access to your personal information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the personal information that we hold about you. If you require assistance in preparing your request, please contact our Privacy Officer.
Your right to access the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In addition, the personal information may have been destroyed, erased, or anonymized in accordance with our record retention obligations and practices. In the event that we cannot provide you with access to your personal information, we will endeavour to inform you of the reasons why, subject to any legal or regulatory restrictions.
- Links to third-party websites.
The Online Argo Transit Platform may contain links to other websites that may be subject to less stringent privacy standards. These links are provided for your convenience only and you assume all risk for clicking these links to other websites. We cannot assume any responsibility for the privacy practices, policies or actions of the third parties that operate these websites. Argo is not responsible for how such third parties collect, use or disclose your personal information. You should review the privacy policies of these websites before providing them with personal information.
- Revisions to this Privacy Policy.
Argo may make changes to this Privacy Policy from time to time to reflect changes in its legal or regulatory obligations or in the manner in which we deal with your personal information. We will post any revised version of this Privacy Policy within the Online Argo Transit Platform [and on the Argo website located at www.rideargo.com].
If we make any material changes, we will notify you as required by law, but encourage you to check back often for updates. Your continued use of the Argo Transit Platforms after an update or amendment to this Privacy Policy means that you consent to the collection, use, and disclosure of your personal information as described in the updated Privacy Policy.
